This is an antidumping and countervailing duty (AD/CVD) trade measure concerning polyester textured yarn from Indonesia, Malaysia, Thailand, and Vietnam. Antidumping duties address imports sold in the United States at less than fair value; countervailing duties address benefits, or subsidies, provided by a foreign government. The measure may apply in addition to ordinary customs duty, depending on the product’s tariff classification and the scope description.
“Institution of five-year reviews” means the authorities are reviewing whether the AD/CVD orders should remain in place. The review is sometimes called a sunset review. It is not, by itself, a finding that every shipment owes a particular amount. Importers must compare the merchandise’s technical characteristics and origin with the official scope, then confirm the applicable case information, tariff classification, and entry requirements with official sources or a qualified customs professional.
What to check
- Read the official scope language, including product descriptions, exclusions, yarn characteristics, and any physical or chemical specifications.
- Confirm the country of origin and the correct Harmonized Tariff Schedule (HTS) classification; an HTS number alone may not determine scope coverage.
- Check whether the entry is subject to an AD/CVD order, and review current instructions from U.S. Customs and Border Protection (CBP) for cash-deposit and entry-reporting requirements.
- Keep product specifications, invoices, bills of materials, production records, and origin documentation that support your scope and classification analysis.
- Ask a customs broker or trade-remedy professional to review close or mixed-product cases, especially when the product description and tariff classification do not align.
Legal basis
